Apple, Google in secret patent settlement talks?

Behind the scenes, Google and Apple CEOs Larry Page and Tim Cook have been in talks over the two companies' patent disputes, according to reports.

The two chief executives are reported to have spoken about a wide range of intellectual property issues. Patent use and infringement is likely to be high on the agenda, against Apple's recent victory over Samsung, who uses Google's Android OS in their mobile devices.

First reported by Reuters, sister site CNET later confirmed that at least one conversation has occurred between the two chief executives. Cook and Page talked before a verdict was reached in the high-profile Apple v. Samsung case, and according to sources, will talk again in a few weeks -- although no firm date has been set.

Reuters also reports that ongoing discussions are taking place between lower-level officials of both firms.

A jury awarded Apple $1.05 billion in damages last week, and there is the possible of sales bans on particular Samsung products -- but in the same breath, a Japanese court found Apple guilty of infringing several Samsung patents. Google, however, distanced itself from Samsung's defeat; immediately declaring that most of the disputed patents "don't relate to the core Android operating system."

Competition is increasing the stakes between the two rival firms as the 'PC era' dwindles and mobile devices take the helm. Late Apple co-founder Steve Jobs believed Google's Android OS was a "stolen product" which has become embroiled in a number of patent disputes across the globe, but it has become Apple's iOS rival and remains installed on hardware from vendors including Samsung.

Tim Cook has been CEO of Apple for roughly a year, whereas Larry Page stepped in at Google a scant few months beforehand, taking over from Eric Schmidt.

I love my new Galaxy S III phone . . . but

Samsung-Galaxy-S-III I?ve been looking forward to upgrade time for my cell phone for a while ? my Droid X served me well but was becoming a bit long in the tooth.? I thought about getting an iPhone this time around, but I do like Android and I opted for the Samsung Galaxy S III instead.

By all accounts the S3 has been a major success for Samsung, and it is easy to see why.? The phone features a gorgeous, mini tablet-sized 4.8-inch Super AMOLED display.? That might sound like more than you would want to carry around in your pocket, but the S3 is very thin and light and more comfortable to hold and use than you would expect from a device with a screen this large.

Other notable features include an 8MP camera, great battery life and a snappy processor that gives the phone good performance and responsiveness and, when combined with a 4G connection, makes for a very good web browsing experience.?? If your friends also have S3 phones, Samsung has added a number of proprietary features that will make sharing with them very easy.? Samsung has packed a ton of features into this phone, many of which I?ll probably never get around to using.

However, one thing I?m finding that the Galaxy S3 may not be so well suited for is reading ebooks.? The version of the AMOLED display that Samsung chose to use on the S3 is not quite as sharp and bright as the displays of many other smartphones, including the Super AMOLED+ screen used in last year?s Galaxy S II.

I do find reading ebooks on the S3 less comfortable than on my old Droid X.? The problem becomes worse the more tired I and my eyes are.? Most likely this will not be an issue for many people ? my eyes are light sensitive and I can have problems if I read for extended periods of time on a backlit screen, although the small screen of a smartphone generally causes me less grief than that of a tablet.

OLYMPUS DIGITAL CAMERA         Since I only tend to read ebooks on my phone when I?m on the road and have time to kill between appointments ? something that doesn?t happen all that often ? this is not a deal killer for me; I still love this phone.? I also carry a tablet I can switch to if need be.? But if you do read a lot of ebooks on your phone you may want to check out your favorite ereading app on an S3 demo unit to make sure you are okay with it before you buy one.

I?ve been looking at the Kindle app on other phones over the past couple of weeks and trying to make a photographic comparison, but the problem does not photograph well.? The photo above shows two different Kindle books on the Samsung Galaxy S III (left) and the Motorola Droid X.? The font on the S3 looks a little thinner, lighter and less contrasty and this is no doubt much of the problem.? I?m thinking that just perhaps this is something that could be addressed to some extent if some optimizations for the S3 were included in future reading app updates ? the popularity of the S III may justify that.

BEIRUT (AP) ? Syrian activists said rebels shot down a government warplane over the northern province of Idlib on Thursday, the second time in a week that opposition fighters claimed to have brought down an aircraft in the escalating civil war.

Two activist groups, The Local Coordination Committees and the Britain-based Syrian Observatory for Human Rights, said the plane was seen crashing near the Abu Zuhour air base. Idlib-based activist Alaa al-Din said rebels shot it down with heavy machine guns.

A video broadcast on the pan-Arab satellite station Al-Arabiya shows what appears to be a person parachuting and rebels cheering and claiming he was the pilot. The video's authenticity could not be verified.

The government had no immediate comment, and the report couldn't be independently confirmed.

Over the past month, President Bashar Assad's regime has been relying much more heavily on air power, escalating the fight with rebels as its ground forces have been stretched thin fighting on many fronts including Syria's two largest cities ? Damascus and Aleppo. The military has conducted air raids on the northern regions of Idlib and Aleppo near Turkey as well as the eastern province of Deir el-Zour.

The increased use of air power is likely a factor in the high daily death tolls, which activists say have been averaging 100-250 lately.

This was the third time this month the rebels claimed to have brought down a government aircraft.

Earlier this week, the opposition fighters said they shot down a helicopter in the Damascus neighborhood of Jobar while the government confirmed a chopper crashed in nearby area of al-Qaboun. On Aug. 13, rebels claimed to have shot down a regime MiG-23 warplane and captured the pilot in Deir el-Zour. Syria says the pilot ejected after a technical malfunction in the fighter jet.

If the rebel claims are confirmed, it would be another blow to Assad's regime, which has been struggling to put down rebel challenges around the country even though its firepower is far superior to the opposition's.

Rebels appear to be targeting air bases with increasing frequency.

Earlier in the day, the Observatory reported explosions inside the Abu Zuhour air base in Idlib, near where the plane was reported to have been shot down. It added that rebels have captured parts of the compound.

On Wednesday, state news agency SANA reported that government forces repulsed a major rebel attack on a helicopter military base of Taftanaz, also in Idlib province.

Idlib, which borders Turkey, has been one of the major rebel strongholds since last year. Although government troops control the provincial capital, which carries the same name as the province, rebels move freely in towns and villages in the district.

In Iran, Egyptian President Mohammed Morsi described the Syrian regime as "oppressive" and called for it to transfer power to a democratic system. He was speaking at the opening of a summit of the 120-member Nonaligned Movement in Tehran.

Morsi's comments angered the Syrian delegation, which walked out in protest, according to Syria's state-run media.

Syrian Foreign Minister Walid al-Moallem, who is also in Tehran, was quoted by the state-owned Al-Ikhbariya TV as saying: "Morsi's comments violated the traditions of the summit and are considered interference in Syrian internal affairs." He also accused Morsi of "instigating blood shedding in Syria."

Iran is Syria's closest ally in the Middle East.

Morsi is an Islamist from the Muslim Brotherhood, the most powerful political force to emerge from last year's uprising that ousted longtime authoritarian leader Hosni Mubarak. The Sunni fundamentalist group opposes Shiite Iran's staunch backing of the Syrian regime and its lethal crackdown on the largely Sunni opposition. Assad belongs to the minority Alawite sect, an offshoot of Shiite Islam.

Assad, speaking in a rare TV interview broadcast on Wednesday, said his armed forces will need time to defeat the rebels ? an acknowledgement of the difficulties the military is facing in winning the civil war.

A member of Syria's main opposition group said his comments aimed to explain his security forces' failure in putting down the rebellion. British-based opposition activist Ausama Monajed, who is a member of the Syrian National Council, said in a telephone interview that Assad's statements tried to "justify the failure of the security solution."

"He is trying to boost the morale of his supporters. He is trying to justify the failure of the military solution that has been going on for months," Monajed said. "His comments were addressed to his constituency."

Activists estimate more than 20,000 people have been killed since the uprising against Assad's began more than 17 months ago.

Facebook is mishandling its crisis, experts say

Here I am! Wall Street is wondering where Facebook Chief Executive Officer Mark Zuckerberg is as its stock languishes at half its debut price. PR experts say he needs to show leadership or find someone who will.

?Where is Mark Zuckerberg?

The question was posed rather forcefully by CNBC host Jim Cramer last week as the social network?s share price continued to plunge and news broke that an early Facebook investor, Peter Thiel, had sold $400 million worth of stock in the company.

The drop in the value of Facebook since May has caused huge concern about the company on Wall Street, and media outlets have even called for the resignation of the company?s founder and CEO Mark Zuckerberg. Facebook shares were trading at around $19 recently, about half?their $38 price when they went public on May 18.

Cramer?s query echoes a broader feeling on Wall Street about the problems now bedeviling the popular social networking company: With the value of its shares down over 50 percent since its highly anticipated IPO, is the company making a hash of the public relations disaster it is now facing; and, just as important,?why has Zuckerberg remained quiet about the state of the company?

Facebook is in crisis, and in a crisis a company?s CEO should be front and center, acknowledging the key issues, apologizing to those affected and giving a commitment to not letting an incident happen again, said Larry Chiagouris, a marketing professor at Pace University?s Lubin School of Business.

?The company needs to make the investment community comfortable that it has people at the top that are serious and determined to make profits,? he said.

?The wonderful thing about the stock market is, in the final analysis, the price of something tends to move toward its real value, so if there really is value in Facebook beyond its current price, the management team has failed to communicate that to investors effectively,? Chiagouris added.

Increasingly, investors are asking if Facebook?s problems are more profound than simply a swooning stock price.

Technical glitches marred Facebook?s first day of trading on the Nasdaq stock market in May, leading to complaints of slow order confirmations and too many shares offered at too high a price. Lawsuits against Facebook and its underwriting banks followed, and Facebook?s share price hasn?t traded anywhere near its $38 offering price since then.

Facebook?s IPO was expected to be one of the biggest stock offerings to ever hit Wall Street, and the company?s offer price?valued the company at $104.2 billion, making it the largest company to go public in the U.S. by market capitalization.

Investors? love for Facebook drove interest in its IPO to extreme levels, and the same herd mentality is now working in reverse, said Chiagouris.

?[Facebook?s stock price] will eventually get to a point where its valuation is unrealistic,? he said. ?To turn that decline around, Facebook has to do a major move -- one would be to replace top management.?

While Mark Zuckerberg is clearly inventive, no one will ever say that he is an effective businessman, Chiagouris said. The company needs to turn the reins over to people who are ?adult? and not beholden to Zuckerberg, he added.

?Facebook has one thing that people want: The largest community in the world. That?s a wonderful asset, but they?re sitting on that asset and they haven?t figured out how to monetize it yet,? Chiagouris said. ?Facebook needs people who are savvy at monetizing an asset, and that would probably not include most of the top managers who are there now.?

Facebook?s Chief Operating Officer Sheryl Sandberg has long been seen on Wall Street as Facebook?s ?adult? executive, having spent years as a senior executive at Google. But Sandberg has yet to demonstrate any independence at the company, Chiagouris said, and despite her appointment to Facebook's seven-person board last June the company?s stock price has continued to slide.

When it comes to handling a crisis, Facebook?s management team has done a poor job, public relations experts say.

As a social media company, Facebook?s image is its most vital asset, said Mario Almonte is a partner at a New York-based Herman & Almonte Public Relations.

?Once MySpace lost its image, it lost its cool factor,? Almonte said. In the same way, Facebook is having an image problem, and this time it?s with Wall Street investors.

The main problem is Zuckerberg, Almonte said.

?He?s locking himself in a room somewhere and refusing to talk to anyone,? he said. ?I think he needs to swallow his pride and bring in experienced people who understand Wall Street and understand the nature of investing and the politics of Wall Street, because a lot of this is about perception.?

?Zuckerberg needs to step up to the microphone and assure them he is working on a strategy to make Facebook profitable for them - and then he must bring in better financial and marketing experts than himself to develop a clear strategy for transforming Facebook into a profitable enterprise,? he added.

Investors have grown skeptical of the company?s ability to communicate its plan to reverse slowing revenue growth and make money from mobile devices -- a channel of strong user growth.

Google is an example of a technology company that got its advertising business right, Almonte said, because ?the advertising is there, all around the user, but it never gets in the way of the clean, efficient user experience.??

"If people had known that [Peter] Thiel would be unloading stock, obviously they wouldn't be buying stock," says Jim Cramer. "Where's the outrage?"

Romney launches pushback on Bain attacks

Romney (Justin Sullivan/Getty Images)TAMPA?After weeks of negative attacks from President Barack Obama and his Democratic allies, Mitt Romney's campaign has signaled that it is ready to launch a major pushback on criticism of Romney's record at Bain Capital.

On Thursday, the campaign unveiled a new website?SterlingBusinessCareer.com?which redirects to a page on Romney's campaign website that talks up what it describes as the candidate's "success in the private sector." It features testimonials from people who worked with Romney while he was at Bain, most of them employees of companies the firm invested in.

The site name is an obvious reference to former President Bill Clinton's defense of Romney in the wake of the Obama campaign's attacks on Bain. In May, Clinton told CNN in an interview that Romney has had a "sterling business career [that] crosses the qualification threshold" for the presidency.

The site was unveiled at the same time that a major portion of the schedule at the Republican National Convention on Thursday has been dedicated to a defense of Romney's time as a venture capitalist at Bain. Bob White, a longtime Romney friend and adviser who worked with him at Bain, will talk about Romney's time there. Another speaker will be Tom Stemberg, the founder of Staples, which was founded with seed money from Bain.

The candidate himself is expected to speak about his time at Bain?though aides would not indicate how much. Romney has struggled to answer attacks on his record at Bain?in part because of his own reluctance to discuss his history there.

But there have been signs that the Romney campaign is changing its strategy. Last week, on the eve of the convention, Romney authored an op-ed in The Wall Street Journal talking about the lessons he learned while he was at Bain.

Twiggy is our beautiful red kneed tarantula who happens to be an escape artist. We have ordered the Amber Alert for arthropods and placed Missing fliers around the building, but to no avail. We care about Twiggy and hope we?ll find her soon. However, if she did escape the building it is not cause for panic. In general, spiders including tarantulas are beneficial arthropods, and fortunately, Twiggy is not an invasive species, she is classified as an exotic pet. However, this presents a good opportunity to discuss the difference between exotic and invasive exotics animals and the ways invasive exotic pets have been introduced into Florida. For instance, the red rump tarantula is classified as an invasive exotic because it was released by an irresponsible pet owner and has now become established in Florida. Dr. G.B. Angola rebel bastion is key battlefield in vote

Once the stronghold of the feared Unita rebels, Angola's second city Huambo has emerged as a key battlefield in Friday's general elections as the party struggles in politics to regain its territory.

"This year the battle is going to be competitive. The ruling party is no longer certain of easy victory, and its historic rival needs to prove that it can still mobilise" its supporters, said Alicerces Mango, a local official with the new Casa opposition party.

Huambo resonates with symbolism from the 27-year civil war. As the stronghold of the Union for the Total Independence of Angola (Unita), the city of 400,000 people suffered some of the war's most crushing battles.

The southern city infamously lived under siege for 50 days. After the war, Huambo was left devastated.

It finally fell to President Jose Eduardo dos Santos and the ruling MPLA in 2008 elections, when the People's Movement for the Liberation of Angola won the province's five seats in parliament.

That victory more than anything exposed the frailty of Unita as an opposition party, without its notorious leader Jonas Savimbi who was killed by the army in 2002. Unita took only 10 percent of the ballots in 2008.

"Today we are better organised," said Liberty Chiyaka, Unita's provincial secretary. "We have visited all the villages to explain that their vote is secret. We will have two party representatives at each polling station, and will do our own compilation of the results."

"Unlike in 2008, we can monitor the vote, and we will do everything to minimise the impact of fraud," he said.

Unita has used its campaign to underscore worries about the election, from the integrity of the voter roll to the MPLA's use of public resources -- especially the broadcast media -- in its campaign.

The party faces other challenges from within. Top Unita leader Abel Chivukuvuku split away in April to form the new Casa party with a top MPLA figure and a clutch of smaller opposition parties.

Born not far from the city, Chivukuvuku could also pull votes from Unita.

Faced with an energetic if small opposition, Dos Santos came to Huambo to lead a rally and to inaugurate the Gove dam, a $279 million project that will bring electricity to Huambo province and neighbouring Bie.

Fierce campaigning sometimes sparked clashes between MPLA and Unita supporters, despite repeated calls for peace from both parties.

"The population is still traumatised by the resumption of fighting after the 1992 elections. In the countryside, for many people, voting is still synonomous with war," said Jose Maria Katiavala, a sociologist and local official in a rural development programme.

"This electorate, rural and with little education, was won over by MPLA when the opposition was busy wooing the urban vote, which is young and skilled. Political consciousness is starting to develop but remains small across the country," he said.

"I'm going to vote for Casa because the country needs change," said Tiago Jay Chimico, 22, outside the party's local headquarters. Support for the new party is one more sign of how far removed the young generation is from the famous two combatants in the civil war.

More than half of Angolans are under 18, and the youth vote is hugely important. But how they will vote, and how the broader public will respond to pressing social concerns like jobs, water and housing are the great unknowns in this election.

"Despite the government's efforts, there's a lot of public frustration with unemployment and the lack of opportunity for the youth," said Huambo Archbishop Dom Jose Queiros Alves.

Colorado shooting victims' families blast fundraising charities

AURORA, Colorado (Reuters) - Families of people killed and wounded in a shooting rampage inside a Colorado movie theater in July said on Tuesday they were being denied a voice in how $5 million in donations raised to help them was being dispersed.

Tom Teves, whose son Alex was killed, said the first disbursement of funds went to various charities instead of victims and that a committee charged with distributing the money does not have any victims or their families on it.

"We are certain that everyone who donated their hard-earned wages intended for 100 percent of their donations to go directly to the victims," Teves said. "Unfortunately, it does not seem to be the case."

In an emotional news conference, 18 people representing families of the 12 who were killed and 58 who were wounded in the shooting accused some charities of soliciting funds by using victims' photographs without permission.

The Community First Foundation said $350,000 had been given directly to the victims or their families. The foundation, which manages the Aurora Victim Relief Fund, said it was dispersing money through smaller local charities that are responsible for distributing it to victims and their families.

Teves said $5,000 was given to each of the 70 victims' families only after they threatened to make public their concerns.

"The victims of 9/11 had similar issues with non-profit organizations keeping the donations from directly going to the victims until a handful of families put a stop to it," Teves said.

Community First's Executive Vice President Cheryl Haggstrom said, "We don't have direct communication with the families, but have been relying on professionals from police to the district attorney's office and victim advocates for them to tell us when it's the best time to include them."

She said the foundation was in the process of arranging a meeting with victims to get their input.

Former University of Colorado graduate student James Holmes, 24, is accused of opening fire inside the theater in Aurora on July 20 during a midnight screening of the Batman movie, "The Dark Knight Rises". He is being held in solitary confinement and without bond in the Arapahoe County jail.

U.S. Navy veteran Josh Nowlan, 32, who was severely wounded in the shooting, said he was slowly recovering but added that he knows families of those who died were suffering. "If I was a millionaire, I would give every dollar of it to them," he said.

Investigators ID Cause of Reno Air Races Crash

Nearly a year has passed since pilot Jimmy Leeward lost control of his modified P-51 during the Reno Air Races and plummeted into the crowd. The fiery crash killed 10 spectators and Leeward.

In the early days after the accident, the cause appeared to be a piece of the plane called the elevator trim tab. As PM contributor Jeff Wise wrote last September, the tab has been linked to similar accidents in the past. In air races like Reno, pilots deploy the small piece of metal out as far as they can to stabilize the plane, but that can put a tremendous amount of stress on the tab.

Yesterday the National Transportation Safety Board released its final report on the crash, which says, yes, the failure of the trim tab was the cause off the accident. Specifically, NTSB says: ?deteriorated locknut inserts? allowed the trim tab attachment screws to become loose, and even initiated fatigue cracking in one screw. This condition, which resulted in reduced stiffness in the elevator trim system, ultimately led to aerodynamic flutter at racing speed that broke the trim tab linkages, resulting in a loss of controllability and the eventual crash."

Pilots push these planes to the limit, and this isn?t the first time disaster struck at Reno. The NTSB also says that Leeward made many other alterations to the 70-year-old ?Galloping Ghost," but that its investigators could find no evidence he properly notified the FAA about some of them.

The 2012 Reno Air Races begin Sept. 12.

Small family size increases wealth of descendants but reduces evolutionary success

ScienceDaily (Aug. 28, 2012) ? Scientists have taken a step closer to solving one of life's mysteries -- why family size generally falls as societies become richer.

Evolutionary biologists have long puzzled over this because natural selection is expected to have selected for organisms that try to maximise their reproduction. But in industrialised societies around the world, increasing wealth coincides with people deliberately limiting their family size -- the so-called 'demographic transition'.

In a study published in Proceedings of the Royal Society B: Biological Sciences, researchers from the London School of Hygiene & Tropical Medicine, the Centre for Health Equity Studies (Stockholm University/Karolinska Institutet) and UCL (University College London) reject a popular theory put forward to explain the phenomenon. This 'adaptive' hypothesis proposes that low fertility may boost evolutionary success in the long term by increasing offspring wealth, which in turn eventually increases the number of long-term descendants because richer offspring end up having more children.

The researchers found that having a small number of children increased the economic success and social position of descendants across up to four generations, but reduced the total number of long-term descendants. They conclude that the decision to limit family size can be understood as a strategic choice to improve the socioeconomic success of children and grandchildren in modern societies, but this socioeconomic benefit does not necessarily translate into an evolutionary benefit.

The study indicates a conflict in modern societies between behaviours promoting social and economic benefits versus biological success. This contrasts with traditional populations in the developing world, where behaviours that promote wealth and social status usually lead individuals to leave behind more genetic descendants.

The researchers tested these hypotheses using data from the Uppsala Multigenerational Birth Cohort Study, which tracks 14,000 people born in Sweden in the early 1900s and all their descendants to the present day.

They measured the socioeconomic success of each generation by looking at their school marks, at whether they went to university and at their household income across adulthood. Reproductive success was assessed by survival to adulthood, marriage before age 40 (a proxy for 'mating success') and fertility (number of offspring up to 2009).

Among both male and female children in the original cohort, smaller family size and higher parental socioeconomic position were both associated with substantially higher school marks, university entrance and income. These effects were particularly large when low fertility and high socioeconomic status coincided, with the benefits of small family size being particularly marked in wealthier groups. Moreover, these advantages were in turn passed on to the grandchild and great-grandchild generations.

But contrary to the adaptive hypothesis, small family size and high parental wealth either did not affect reproductive success beyond the first generation of offspring or if anything showed a negative effect in subsequent generations.

Lead author Dr Anna Goodman, Research Fellow at the London School of Hygiene & Tropical Medicine, said: "Under natural selection, you would expect organisms to use their resources to produce more genetic descendants, and so increase their Darwinian fitness. The demographic transition is a puzzle because at first sight it doesn't look like people are doing this. One adaptive explanation for the puzzle is that there exists a quantity-quality trade-off, such that having more children leads to those children being less able to reproduce in turn -- i.e. higher 'quantity' leads to lower biological 'quality'. However our study found this quantity-quality trade off only applied to descendants' socioeconomic success, not their reproductive success."

Co-author Dr David Lawson, from the Department of Anthropology at UCL, said: "One of our most interesting findings is that being from an initially wealthy household makes the benefits of small family size even bigger. Poorer households in contrast have relatively little to gain by limiting fertility, perhaps because the success of their children is more determined by broader societal factors, rather than investment and inheritance from parents, which is in short supply. This observation suggests a certain economic rationality to fertility patterns in the modern world, since fertility rates often drop first and most substantially in the wealthier sections of society when populations undergo demographic transition."

Professor Ilona Koupil, from the Centre for Health Equity Studies (Stockholm University/Karolinska Institutet) said: "It is important to note the equity implications of these findings. First, this research indicates that differences in family size may have lasting consequences on social inequalities. Second, this research provides evidence for the fact that people's educational levels and wealth not only affect schoolmarks and income in their children but also in their grandchildren and great-grandchildren. From a broader social policy perspective, our findings show that even in a country like Sweden with relatively low levels of inequality, we need policies that seek to equalise children's opportunities across families."

If you're a student, you may have harbored the fantasy of learning lessons while you sleep. Who wouldn't want to stick on a pair of headphones, grab some shut-eye with a lesson about, say, Chinese history playing in his ears ? and wake up with newly acquired knowledge of the Ming Dynasty?

Sadly, it doesn't work. The history lesson either keeps you from going to sleep, or it doesn't ? in which case you don't learn it.

But researchers may have taken the first baby step to making the fantasy come true: In an unusual experiment published in Nature Neuroscience, researchers Anat Arzi, Ilana Hairston and others showed that people are capable of learning simple lessons while fast asleep.

The researchers sprayed volunteers with pleasant and unpleasant smells while they were fast asleep. Exactly like people who are awake, the sleeping volunteers took bigger breaths when there was a pleasant smell and a smaller breath when there was an unpleasant smell.

The researchers also paired each kind of smell with a particular sound. After repeated pairings of, say, a pleasant smell with a high-pitched beep, the researchers played the high-pitched beep without the smell: They found the volunteers took a big gulp of air. At least subconsciously, in other words, they were expecting the pleasant smell.

The researchers similarly paired an unpleasant smell ? rotting fish ? with another kind of tone. After repeated pairings, the tone alone caused the volunteers to take a smaller breath.

The phenomenon is known as conditioning, a simple form of learning made famous by Ivan Pavlov and his dog.

When the volunteers woke up, the researchers played the different tones to them. They found that the high-pitched beep caused the volunteers to take a big breath and the low-pitched beep caused the volunteers to take a small breath.

In other words, the conditioning lesson learned while the volunteers were asleep stayed with them after they awoke. Interestingly, the volunteers had no conscious recollection of having learned anything while they were sleeping.

Hairston said the research could help unlock the effects that sleep has on different brain processes. It's been known for a while that a nap can help cement things you've learned; Hairston said the sleep mechanisms that consolidate knowledge may explain why volunteers in the current experiment were able to bring what they learned during sleep into waking hours.

Practical applications of the conditioning technique are still far off, of course. But speculating about potential future uses, Hairston said: "A medical student can learn a list of body organs. You can perhaps pair different organs with smells. So you pair the thalamus with the smell of lemon, and the hypothalamus with the smell of orange blossom. When you wake up, you will have a better recollection of that list!"

Citigroup agrees to pay $590M in shareholder suit

NEW YORK (AP) ? Citigroup has agreed to pay $590 million to settle legal claims by shareholders that its executives misled them about the bank's growing problems before the financial crisis.

The bank denied the allegations Wednesday, but said it agreed to the deal to eliminate the cost and uncertainty of litigating the class-action suit.

Plaintiffs say Citigroup executives kept mum between February 2007 and April 2008 about huge losses the bank faced on complex mortgage investments. When the problem was disclosed, they say, Citigroup's share price plunged. They blame the bank for their losses.

The case, filed in late 2007, was one of the first major lawsuits related to the toxic investments that fueled the financial crisis in 2008. It's also among the biggest proposed settlements of any crisis-related case.

In a statement, the bank said it is "pleased to put this matter behind us." It called the proposed settlement "a significant step" toward resolving the reams of litigation it faces as a result of the financial crisis.

Citigroup was one of the banks hit hardest by the crisis. As it faltered in the fall of 2008, the government made stronger banks take multi-billion dollar bailouts in part to mask Citi's weakness. Citi took direct bailouts totaling $45 billion and relied heavily on other emergency programs from the Federal Reserve. It has repaid the money with interest.

The bank said in its statement that it is "a fundamentally different company today than at the beginning of the financial crisis," having overhauled its risk management, reduced its risky investments and sold off non-core businesses.

Citigroup said it already has set aside enough money to cover the cost of the settlement.

The settlement is subject to court approval by U.S. district judge Hon. Sidney Stein in Manhattan.

Citigroup rose 35 cents to $29.69 in afternoon trading.

?I don?t want to get into what he can do and can?t do,? Nix said of Young, via Tim Graham of the Buffalo News. ?It just didn?t work out.

?Vince did everything that he could. He worked hard at it. He did everything that we asked him to do. It just didn?t work. So we?re going another route.?

When pressed as to why it didn?t work, Nix said: ?Why do we keep talking about Vince?s problems? Vince is gone.?

But his answer to questions about why Jackson was brought in speaks volumes about what they thought of Young.

?We spent a lot of money in the offseason,? Nix said. ?We put a lot of money in this football team, and we think we?ve got good players and a chance to be competitive.

?I wouldn?t want one guy to get hurt and couldn?t play and everybody else be helpless to get it done. So it?s a protection.?

Young has fallen far, and fast. It?s not like the Bills traded for a guy with a long history of winning football (Jackson has a 17-17 career record as a starter), so for Young to have been deemed so deficient that Jackson?s a no-brainer upgrade should tell you what you need to know about his prospects for future employment.

A PROGRAM to rebuild relationships between mothers and their children aims to stop young victims of domestic violence from becoming perpetrators.

In an old sandstone building on the outskirts of Sydney, six children are given pots of paint and asked to create a picture that represents their feelings.

This is no ordinary craft lesson. These children are all here because in their short lives they have seen, heard, and felt too much. As they set to work with their paints, some use dark colours to draw frightening monsters. Others have hope: colourful lovehearts and flowers. All are about domestic violence and how it has affected their lives. ?It helps children understand what has happened and find a non-violent way of relating that,? says Melina Isgro-Rarp, convener of the Kids Create Tomorrow program run by the Benevolent Society.

When we think of domestic violence, we often think of women who suffer at the brutal hands of their partners. But increasingly children ? as witnesses and victims ? are being deeply and detrimentally affected. ?What they learn at a young age not only damages them, it has implications for our society. They learn violence is acceptable,? says Isgro-Rarp. The main aim of her program is to repair the mother-child relationship after they leave a violent home. ?We try to help children and mothers communicate about what happened and restore the mother-child relationship. Often the mother has had her parenting undermined; she has been the subject of humiliation and ridicule in front of her children.?

Take the case of 11-year-old Jake, whose real name cannot be used for legal reasons. In April his step-father badly beat him with a wooden spoon and then locked him in a pet cage in the back yard. ?My daughter came in and screamed, ?Mummy, mummy, Bob put Jake in the cage?,? says Jake?s 35-year-old mother. Jake is now in foster care after bruises on his legs were reported by his school teachers.

Jake?s step-father has been charged with assault. His mother has left the abuser, who was violent to her as well. But this wasn?t the family?s first encounter with a violent man. Jake?s biological father used to beat his mother. She left him 10 years ago when Jake was a baby. When he was just two, Jake?s arm was broken during a court-order access visit with his father. ?It was his turn to have the children and when I picked them up I could see Jake?s arm was broken and he hadn?t even been taken to the hospital.?

Isgro-Rarp says many children end up blaming their mother for their broken family and damaged lives.

?Children are often angry at their mum; you know: Why did she let it happen?? Isgro-Rarp says.

That was the experience of June ? not her real name ? when she left the father of her three children after 16 years of abuse. ?The children witnessed instability, punching of walls, a lot of intimidation, my parenting was undermined and he put me down in front of the children. There is trauma there, they don?t know how to deal with it, they have to blame someone,? says June, 45.

Her eight-year-old son was especially angry at her. Enrolling in the Kids Create Tomorrow program has made an enormous difference to his behaviour and attitude, June says.

?He found he wasn?t the only kid and that it wasn?t my fault and a few weeks in, he just felt he was heard. I learned he was in a lot of pain.?

Domestic violence is so prevalent police across NSW attend up to 330 callouts a day. Children are often witnesses and in up to 70 per cent of cases, they are victims.

The effects on the child are only just starting to be understood. Child developmental psychiatrist Professor Louise Newman says it can often be the reason behind a raft of problems society struggles to deal with: homelessness, drug addiction, alcohol abuse, aggression and violence. Look behind the rise of shocking street violence, unprovoked king hits and stabbings and often violence is in the perpetrator?s background.

?You can pretty much predict in the majority of these violent acts that the young people come from disturbing backgrounds,? Professor Newman says.

?Children, especially very young children, are learning how to manage difficult feelings and aggressive impulses and children exposed to ongoing conflict and abuse of power develop distorted models of how relationships work,? she says.

It can also damage brain development. ?Little children under four, if they are witnessing attacks on their primary care giver, often the mother, it is as if they are being attacked themselves, they are as damaged as if it was an attack on themselves. It?s a high stress situation, it affects the steroid cortisol and high levels of cortisol can impact on brain development,? Newman says.

Dr Bruce Perry from the US-based Child Trauma Academy told Agenda that children who witness domestic violence from a young age often develop post-traumatic stress disorder. ?It?s the fight or flight response, they are over-reactive, have attention problems and behavioural issues ? that or they will withdraw, dissociate and tune out,? he says.

Disturbingly, these children with PTSD will invariably be misdiagnosed as having attention deficit hyperactivity disorder, or ADHD, because the symptoms are similar in a child.

?These kids get drugged with Ritalin,? Dr Perry says.

Assistant Commissioner Mark Murdoch is the police spokesperson on domestic violence.

He?s been in the force for more than 30 years and laments that children being violent at home is the fastest growing part of the domestic violence problem.

Kids aged between 10 and 17 now represent about eight per cent of all domestic violence assaults ? that?s kids hitting parents and siblings ? a 25 per cent increase in the past five years.

Alcohol and even violent video games have been central to the debate over what triggers young people to be violent, but Murdoch says violence is often learned at home. ?That?s the logical assumption to make, that kids are witnessing this stuff thinking this is the way people conduct themselves in relationships,? Murdoch says.

?I?m dealing with a woman at the moment who has been a long-term victim of domestic violence. She has four kids, a girl aged 12 and three boys aged nine, six and five, and these kids were part of the violence.

?Whilst the perpetrator focused the violence on her, the kids would scream and cry and then he would threaten them with a machete, hitting the bottom of their beds with the machete.

?He?s been charged but these kids have behavioural issues already. The school is calling every day with trouble and I?d put my house on it the kids will end up as perpetrators of domestic violence because they have seen how dad has treated mum.?

Father Chris Riley runs Youth Off The Street, a charitable outfit that tries to give homeless kids a second shot. He estimates between 80 and 90 per cent of his troubled kids have fled abusive homes.

?One of our current girls ran away from home at 15 because her mother allowed her to be beaten up by successive partners,? Riley says.

?She hates her mother. The other tragic outcome for these girls is they get into inappropriate relationships, they go from refuge to refuge and end up in inappropriate relationships and now this girl is pregnant.?

Prevention is the ideal, yet often elusive solution. But for the children who have endured too much too soon, programs like Kids Create Tomorrow help to patch up the damage in a safe environment.

At the painting session in Campbelltown, 10-year-old Brody, not his real name, has drawn two very different pictures. The first is a monster. ?This is my anger monster,? he says.

?He is a very evil monster and I can control him. He brings anger to me and my family.?

The other picture represents Brody?s hopes for the future.

?This is my peace monster, he wants to come out . He will bring peace to me and the whole world.?

Having to make quick decisions helps witnesses identify the bad guy in a lineup

ScienceDaily (Aug. 28, 2012) ? Eyewitness identification evidence is often persuasive in the courtroom and yet current eyewitness identification tests often fail to pick the culprit. Even worse, these tests sometimes result in wrongfully accusing innocent suspects. Now psychological scientists are proposing a radical alternative to the traditional police lineup that focuses on eyewitnesses' confidence judgments.

In a new article forthcoming in Psychological Science, a journal of the Association for Psychological Science, Neil Brewer of Flinders University and colleagues report a new type of lineup in which witnesses are presented with lineup photos one at a time and are simply asked to rate how confident they are that the person in each photo is the culprit. Importantly, witnesses are not given time to mull over their assessments; they must respond within a few seconds.

Brewer and his colleagues have tested this technique, called "deadline confidence judgments," with more than 900 participants across several experiments conducted over the past three years.

In each experiment, volunteers watched short films depicting crimes or a mundane event in which one person was prominent.

Either five minutes later or a full week later, half of the participants were shown a series of individual pictures from a lineup of 12 people and asked to make a confidence decision about each face within three seconds of it appearing on the computer screen. They were asked to choose one of 11 options, ranging from "absolutely confident that this is the culprit" to "absolutely certain this is not the culprit."

The other half of the participants were shown the same faces but given as long as they liked to answer whether each face was or was not the culprit (yes or no). Sometimes the photos included the culprit and sometimes they did not.

Using an algorithm to infer a decision from participants' confidence ratings, the researchers found that overall classification accuracy was 20 to 30 percent higher for the new lineup than the conventional one.

Moreover, the researchers were able to identify particular patterns of confidence judgments that showed either a very high or very low likelihood that an individual witness's judgments were accurate.

The finding that eyewitnesses' judgments were more accurate under a deadline fits with previous research, which has shown that accurate eyewitness identifications are made significantly faster than inaccurate ones, and that a number of outside factors are removed with a short deadline.

"A weakness of the traditional test lies in the fact that it requires a witness to make a single 'yes' or 'no' decision about a lineup, with plenty of time to reflect on their decision," says Brewer. "But the time lapse from the initial viewing to the response often mitigates against witnesses making accurate decisions, as does an array of external factors."

These external factors include the conditions under which people view lineup photos, constraints on attention, and social cues that bias the witness towards a positive identification. For example, a witness might think that she should know they answer just because she viewed a photo for a long time.

According to Brewer, traditional identification tests often fail because the witness feels pressure to identify a guilty party. This new study suggests that witnesses are more likely to make accurate identifications when they do not have to be so precise.

With the rising number of DNA exonerations and the frequent failure of witnesses to identify the true culprit, Brewer believes that there is a compelling case for a new system of lineups.

Former world number one, Serena Williams, proclaimed that the tag of being the best tennis player in the history of women tennis doesn?t suit her. Her fellow former world number one, Kim Clijsters, stated her as the best ever women to have picked up the tennis racquet. Williams honoured the title from the Belgian but stated that she is not worthy of it.

Williams will be the third player to win Wimbledon Championships, Olympics gold medal and the US Open in one year, if she manages to sustain her emphatic run of form and claim the title at New York. She will join the list of two greats of women tennis, one of them being her elder sister, Venus Williams and the only other woman with a Career Gold Slam, Steffi Graf.

However, it will not be an easy task at all considering the form of the Czech starlet, Petra Kvitova, who won two titles from the last three tournaments she played. Defending champion, Samantha Stosur, will also be eyeing to repeat history and prove to the world that the US Open triumph last year was no way a fluke.

Clijsters who will retire at the end of the US Open stated about Williams, ?To me, Serena is the best ever just because I think physically she just stands out. When she's in good shape, I think she just stands out tremendously. I mean, she's fast, she's strong and she has a very good eye as well.?

Williams in response to this honour commented, ?I can't sit here and say I'm the best ever. I'm not. I'm not worthy of that title. You've got to embrace it whether you're the favourite or the one to beat or whether you are not.?

However if she is not the best ever tennis player, she is definitely the very best of her generation and no one has seen such domination at the platform as Williams. She has won 34 of her last 36 matches; clearly shows her potential and ability to single handily dominates a complete grass court season. The US Open will definitely separate the two claims of legendary tennis icons.
